Abstract
This study aims to determine and analyze how the implementation of the high heirloom rice field pawn agreement as well as the causative factors and settlement efforts made from the non-implementation of the high heirloom rice field pawn agreement in indigenous peoples in Palak Aneh Village, South Pariaman District, Pariaman City. The formulation of the problem is: How is the implementation of the high heirloom rice field pawn agreement and the factors that cause and what settlement efforts are made from the non-implementation of the high heirloom rice field pawn agreement in the customary community in Palak Aneh Village, South Pariaman District, Pariaman City? This research method is empirical juridical legal research. The results of this research and discussion state that not all pawn holders of the Palak Aneh Village community fulfill their obligations as agreed in customary law. The factors of the non-implementation of this pawn agreement are due to: 1) Lack of Communication between the Parties; 2) Harvest Failure; 3) There is no redemption deadline. The settlement efforts made by deliberation and consensus.
